Terms of Service

These Terms govern your use of the Cipher mobile application, operated by Cipher Tracker LLC, a limited liability company registered in the State of Illinois.

By creating an account, downloading, installing, or using Cipher, you agree to them. If you don't agree, don't use the app.

Section 1

Who can use Cipher

Cipher is for people 18 or older. It includes tracking for alcohol, cannabis, nicotine and other substances, and is not designed for minors.

By using Cipher you confirm you are at least 18. We do not knowingly collect data from anyone under 18, and will delete the data of any minor we learn about.


Section 2

What Cipher is, and isn't

Cipher is a personal tracking tool. It helps you log habits, health data, and wellness information for your own reference.

Cipher is not a medical device, a medical service, or a substitute for professional medical advice. It does not diagnose, treat, cure, or prevent any disease or condition.

  • Medication tracking is for personal organization only. It does not replace a pharmacist's or doctor's instructions, and Cipher does not model prescription schedules — it cannot tell you whether you missed a dose.
  • Menstrual cycle predictions are estimates from your own logged data. They are not reliable for medical decisions, family planning, or contraception.
  • Exercise, calorie and nutrition figures are approximate. Food data from FatSecret may not be accurate for every product or serving size.
  • Sleep, substance and screen time data reflect what you enter or what your device reports. We make no guarantee about device-reported accuracy.

Do not make health decisions based solely on Cipher. Talk to a doctor about health concerns, and contact emergency services in an emergency.


Section 3

Your account and password

You choose a username and a password. Your password generates your encryption key and is the only way to reach your data. You are responsible for keeping it safe, remembering it, and for activity under your account.

A PIN, if you set one, protects local access to the app. It does not replace your password.


Section 4

Subscriptions, free trial, and renewal

Free tier: one tracker of your choice, at no cost, with no time limit.

Cipher Pro: every feature the app has, including all trackers and full analytics.

Prices are in US dollars and vary by country. The price shown in the app at the moment of purchase is the price that applies. We may change prices for future billing periods; where the law requires it we will give you notice and a chance to cancel first.

Renewal and cancellation

  • Subscriptions renew automatically at the then-current price until cancelled, and you are charged within 24 hours before each new period starts.
  • To avoid a charge, turn off auto-renewal at least 24 hours before the period ends.
  • Cancel in your Apple ID or Google Play settings, not inside Cipher — we have no ability to cancel for you. iOS: Settings → your name → Subscriptions. Android: Play Store → Profile → Payments & subscriptions.
  • Cancelling stops future charges. It does not refund the current period, and Pro access continues until that period ends.

Refunds

Apple and Google handle refunds under their own policies. We cannot process, approve, or issue refunds directly. Ask via reportaproblem.apple.com or Google Play. If you are a consumer in the EEA or UK this does not affect your statutory rights — see section 17.

Lifetime, and what happens after

“Lifetime” means the lifetime of the Service, not of the subscriber. If Cipher ceases to operate, lifetime access ends with it — see section 14 for what we owe you in that case.

If a subscription expires or is cancelled, access reverts to the free tier. Your data is not deleted — it stays encrypted on our servers and is available again if you resubscribe, subject to the inactivity rule in section 3.

Promotional codes

Promo codes granting temporary Pro access are non-transferable, have no cash value, may be limited to one per account, and may expire or be deactivated. Promotional access creates no store subscription and cannot be refunded.


Section 5

Your data

Our Privacy Policy explains how we handle data, and the Consumer Health Data Privacy Policy covers extra rights for Washington and Nevada residents. Using Cipher means agreeing to the Privacy Policy too.

Your tracker data belongs to you. We claim no ownership over anything you enter, and we use it for nothing beyond providing the Service — which we could not do anyway, since we cannot decrypt it.

Delete everything from Settings in the app, or request it at cipher-app.org/delete-account.


Section 6

How you may use Cipher

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use Cipher for personal, non-commercial purposes. You agree not to:

  • Copy, modify, distribute, or make derivative works of the app
  • Reverse-engineer, decompile, or disassemble it, except where applicable law prohibits that restriction — including statutory interoperability rights under EU Directive 2009/24/EC or equivalent
  • Use the app unlawfully
  • Access other users' data, circumvent authentication, or interfere with the Service
  • Probe or test our systems' vulnerability without prior written permission (see section 8)
  • Use bots or scrapers against the Service
  • Impersonate another person
  • Circumvent or defeat the paywall or entitlement checks
  • Resell, rent, or sublicense access

Section 7

Intellectual property

Cipher, its design, code, icons and content are owned by Cipher Tracker LLC. These Terms grant you no ownership in them.

Nutritional data in the Calorie tracker comes from FatSecret and is subject to their terms. Exercise instruction images come from the Free Exercise DB and are public domain.

If you believe content here infringes your copyright, email app@cipher-app.org with the work, its location, your contact details, and a statement of good-faith belief that the use is unauthorized. We respond to valid notices.


Section 8

Security research

Good-faith security research is welcome. Email app@cipher-app.org before disclosing anything publicly and give us a fair chance to fix it.

We will not pursue researchers who act in good faith, do not access, modify or delete other users' data, do not degrade the Service, and allow reasonable time to respond. This is a deliberate exception to section 6.


Section 9

Disclaimer of warranties

Nothing here excludes or limits any warranty, right, or remedy that cannot lawfully be excluded, including consumers' statutory rights. See section 17.

Subject to that, and to the maximum extent permitted by law:

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • Results obtained from it will be accurate or reliable
  • Errors will be corrected
  • Notifications, reminders or alerts will be delivered reliably or on time
  • Food database, nutritional or barcode data will be accurate
  • Cycle predictions or health estimates will be correct
  • Data will sync successfully, or that cloud backup will be available

We offer no service level agreement and commit to no specific uptime.


Section 10

Limitation of liability

Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, and TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIPHER TRACKER LLC AND ITS OWNER, OFFICERS, EMPLOYEES, AGENTS AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING:

  • Loss of data, including data unrecoverable after a forgotten password or deleted after account inactivity
  • Loss of profits, goodwill, or business opportunities
  • Missed medications, incorrect dosage information, or medication tracking errors
  • Health decisions made from data shown in the app
  • Injuries sustained during exercise tracked or suggested by the app
  • Inaccurate nutritional information from third-party food databases
  • Reliance on cycle predictions, including for contraception or conception
  • Damage from unauthorized access to your account
  • Service interruptions, bugs, or sync failures

IN NO EVENT SHALL OUR TOTAL LIABILITY FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

Some jurisdictions do not allow these exclusions. There, our liability is limited to the greatest extent the law permits.


Section 11

Indemnification

To the extent the law permits, you agree to indemnify and hold harmless Cipher Tracker LLC and its owner, officers, employees and agents against third-party claims, liabilities, damages, losses and costs (including reasonable attorney fees) arising from your violation of these Terms, your violation of third-party rights or applicable law, or your misuse of the Service.

This does not apply to consumers to the extent your local consumer protection law prohibits it.


Section 12

Third-party services

Cipher relies on:

  • Google Firebase — encrypted storage, authentication, server functions
  • RevenueCat — subscription management
  • FatSecret — food and nutrition data
  • GitHub — public-domain exercise images
  • Apple / Google — in-app purchases

We are not responsible for their availability, accuracy, or conduct. Your use of them is subject to their own terms.


Section 13

Ending it yourself

Stop using Cipher whenever you like. Delete all your data from Settings in the app, or at cipher-app.org/delete-account. Deletion is permanent.

Deleting your data does not cancel your subscription. Cancel that separately through Apple or Google, as described in section 4.


Section 14

Suspension and termination by us

For cause. We may suspend or terminate access immediately if you materially breach these Terms, use the Service unlawfully, or try to compromise it or other users. Where practical and lawful we will say why and let you respond.

For convenience. We may discontinue the Service, or terminate accounts without cause, on at least 30 days' notice in the app or on this website.

On termination your right to use the Service ends immediately. Sections that should survive by their nature do, including 5, 7, 9, 10, 11, 15, 16, 17 and 19.


Section 15

Changes to these Terms

We update the date at the top when these Terms change. For material changes — pricing, the liability limits in section 10, or the dispute terms in section 16 — we give at least 30 days' notice in the app or by email before they take effect. If you disagree, cancel and stop using the Service before then; that is your remedy.

Continuing to use Cipher after a change takes effect means you accept it. We do not apply material changes retroactively.


Section 16

Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Disputes are resolved in the state or federal courts of Cook County, Illinois, and you consent to their jurisdiction.

Talk to us first. Before filing anything, email app@cipher-app.org and give us 30 days to resolve it. Most things can be sorted out that way.

Consumers elsewhere. If you are a consumer, this section does not deprive you of your local mandatory protections, nor of any right to bring proceedings in your own courts. See section 17.


Section 17

Consumers in the EEA, UK and elsewhere

If you are a consumer, you have statutory rights these Terms cannot remove:

  • Nothing here limits your mandatory statutory rights, including those covering digital content that is faulty, not as described, or not fit for purpose.
  • Right of withdrawal. In the EEA and UK you generally have 14 days to withdraw from a digital content purchase. Because Apple or Google made the sale, exercise it through them. The right may be lost once you start using the content, where you consented to immediate performance.
  • Governing law. The Illinois choice in section 16 does not deprive you of mandatory protections in your country of habitual residence.
  • Disputes. EU consumers may use the European Commission's Online Dispute Resolution platform, and may bring proceedings in their own courts.
  • Australian consumers. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Where a term here conflicts with a mandatory consumer protection law that applies to you, that law wins and the rest of these Terms stay in effect.


Section 18

Apple App Store users

These apply if you got Cipher from the Apple App Store, and control as to Apple in any conflict.

  1. 01These Terms are between you and Cipher Tracker LLC only, not Apple. We, not Apple, are solely responsible for the app and its content.
  2. 02Scope of licence. Your licence is non-transferable and limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
  3. 03Maintenance and support. We are solely responsible for these. Apple has no obligation whatsoever to furnish any maintenance or support services.
  4. 04Warranty. We are solely responsible for any product warranties, express or implied, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
  5. 05Product claims. We, not Apple, address any claim by you or a third party relating to the app, including product liability, failure to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar legislation — including in connection with the app's use of the HealthKit and HomeKit frameworks.
  6. 06Intellectual property claims. If a third party claims the app infringes their intellectual property, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. 07Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  8. 08Developer contact. Questions, complaints or claims go to Cipher Tracker LLC, 2936 N Dawson Ave, Chicago, IL 60618, United States — app@cipher-app.org.
  9. 09Third-party terms. You must comply with applicable third-party terms when using the app.
  10. 10Third-party beneficiary. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that on your acceptance Apple has the right — and is deemed to have accepted the right — to enforce these Terms against you as a third-party beneficiary.

Section 19

General

  • If a provision is unenforceable it is modified only as far as necessary, and the rest stays in effect.
  • Failing to enforce a right does not waive it.
  • These Terms, with the Privacy Policy and the Consumer Health Data Privacy Policy, are the entire agreement between us regarding the Service.
  • You may not assign your rights. We may assign ours in a merger, acquisition or sale of assets, on notice to you.
  • We are not liable for failure to perform due to events beyond our reasonable control.
  • Notices to you may be given in the app or by email; notices to us go to app@cipher-app.org.
